On 4 October 2024, the Court of Justice of the European Union made a landmark decision on Afghan women’s recognition as refugees. The Court made significant findings in relation to discrimination amounting to persecution and group-based refugee status determination, stating that EU Member States could recognise Afghan women as refugees merely based on their gender and nationality without having to take into consideration further personal circumstances and characteristics.

The decision follows the Opinion of the Advocate General in November 2023.
